The Committee on Government Organization moves to amend the bill on page 2, line 1, by striking the period and inserting in lieu thereof a comma and the words, "with the following amendment:
On page 4, by striking the section heading and inserting the following, "º173-1-3 Requirements for Receiving Grants."
On page 4, by inserting a new section 3.1, which states the following, "3.1 A public library must fulfill all of the requirements set forth in this section to be eligible to receive a grant from the library commission." and renumbering the section accordingly;
and,
By striking section 5.1 in its entirety and inserting the following, "5.1 Eligibility requirements may be waived if the Library Commission determines that a waiver is necessary due to exceptional or uncontrollable circumstances, such as a natural or man-made disaster, a precipitous decline in the financial resources of a governing authority body, or if a governing body does not dedicate or provide the financial resources necessary to maintain the day to day operation of the library";
and,
By striking section 5.2 in its entirety and inserting the following, "5.2 The board of library directors requests a waiver by notifying the Library Commission in writing of any extraordinary circumstances or the failure of a governing body to dedicate or provide the financial resources necessary to maintain the day to day operation of the library";
and,
By inserting a new section 5.5 to read as follows, "5.5 In the interest of helping libraries remain open for the citizens of West Virginia, this waiver provision is to be construed broadly and in favor of libraries."
On page 8, section 6.2, by striking the word, "may" and inserting the word, "shall" and by striking the word, "only";
and,
On page 13, section 9.1, after the word, "library" by inserting the word, "shall"."
